OpSync Patient Terms and Conditions

  1. Introduction

    You are accessing the patient facing portal of the OpSync Platform (Platform) because your medical practice or practitioner (your medical practice) has facilitated your access. Your medical practice uses this Platform to manage bookings, consents, and related information. The Platform is owned and operated by Caousou Pty Ltd (ACN 664 413 567) (We, us, our).

  2. What these Terms are

    These terms explain how you can use the Platform. By accessing or using it, you agree to follow these terms. If you do not agree, please do not use the Platform and contact your medical practice instead.

  3. Purpose of the Platform and no medical advice

    The Platform is provided for administrative purposes only. For example, to help manage bookings, consents, and information about procedures. It does not provide medical advice, and it is not a substitute for advice, diagnosis, or treatment from a qualified health practitioner. All questions about your health, medical conditions, procedures, or care should be directed to your medical practitioner, not to us.

  4. Your information and records

    Your medical practice controls your records and information in the Platform. We provide the technology only and handle information on behalf of your medical practice. If you would like to see or correct information or records about you, please contact your medical practice directly. We'll work with them to help respond to any lawful requests for access or correction, where required under applicable laws.

    However, we do have a privacy policy that explains how we collect, use, and protect personal information in the Platform, and we make sure we do so in accordance with applicable laws. The privacy policy forms part of these terms and can be accessed on our website.

  5. Your responsibilities

    You are responsible for:

    1. ensuring that any information you enter in the Platform is accurate, that you have the right to provide it, and that it relates only to you (unless you're otherwise authorised); and
    2. reading all information provided to you through the Platform and for contacting your medical practice if you have any questions, or if there is anything you don't understand, disagree with, or believe is missing.
  6. Availability

    We take reasonable steps to protect the security and availability of the Platform, but we do not guarantee it will always be available or error-free. If the Platform is unavailable for any reason, please contact your medical practice directly.

  7. Release

    To the maximum extent permitted by law, you release us from, and we will not be liable for, any claim, loss (direct or indirect), or liability that arises from your use or misuse of the Platform, your reliance on any information or material displayed in the Platform, any incorrect or incomplete information provided by you or your medical practice and/or any act or omission of your medical practice.

  8. Variations to these Terms

    We may update these terms from time to time, for example to reflect changes to the Platform or legal requirements. If we make significant changes, we'll post the updated version in the Platform or let you know about the updates in some other way. By continuing to use the Platform after the changes take effect, you agree to the updated terms. The date these terms were last updated are set out at the start of the terms.

  9. General

    If any part of these terms is found to be invalid or unenforceable, the rest will still apply. Any delay or choice not to enforce a right under these terms doesn't mean that right is waived. These terms are governed by the laws of New South Wales, Australia.
